Warranty

bioMérieux, Inc. warrants the Instrument to the original purchaser for the period of one year after the date of installation, unless otherwise stated on the purchase documentation, against defects in material and workmanship and defects arising from failure to conform to specifications applicable on the date of installation. bioMérieux, Inc. agrees to correct, either by repair or at
its election, by replacement, any such defect found on examination to have occurred, under normal use and service, during such one year warranty period, provided bioMérieux, Inc. is promptly notified in writing upon discovery of such defect. All of the product elements of
the Instrument are warranted to be new or equivalent to new for the full product warranty period except as noted. Disposables and replacement items with a normal life expectancy of less than one (1) year such as batteries, lamps, bulbs, and card trays are excluded from this warranty.

bioMérieux, Inc. shall not be liable under this warranty for any defect arising from abuse of the Instrument; failure to operate and maintain the Instrument in accordance with the Operators Manual; operation of the Instrument by a technologist who has not been trained in its operations at bioMérieux, Inc.’s training school; or repair service, alteration, or modification of the Instrument by any person other than the authorized service representative of bioMérieux, Inc.

bioMérieux, Inc. warranties either implied or expressed are valid to consignee’s premises only. Any transshipments VOID these warranties and bioMérieux, Inc. assumes no liability or obligation.

THE WARRANTY OF bioMérieux, INC. SET FORTH ABOVE AND THE OBLIGATIONS AND LIABILITIES OF bioMérieux, INC. THEREUNDER ARE EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES, WARRANTIES, GUARANTEES OR LIABILITIES, EXPRESSED OR IMPLIED, ARISING BY LAW OR OTHERWISE, WITH RESPECT TO ANY PRODUCTS
DELIVERED HEREUNDER (INCLUDING WITHOUT LIMITATION ANY OBLIGATION OF bioMérieux, INC. WITH RESPECT TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND CONSEQUENTIAL DAMAGES, AND WHETHER OR NOT OCCASIONED BY bioMérieux, INC.’S NEGLIGENCE). This Warranty shall not be extended or altered except by written instrument signed by bioMérieux, Inc.

The prices, specifications, and accessories contained in this catalog were in effect at the time this publication was approved for printing. bioMérieux, Inc., whose policy is one of continuous improvement and innovation, reserves the absolute right to discontinue models and accessories
and to change design or price without notice and without incurring obligation.
